These terms and conditions apply to all website transactions. Please read them carefully before you place any order with Dave Whelan Sports Ltd.
By using the website you agree in full to the terms and conditions contained herein and furthermore this shall constitute a binding agreement between you and Dave Whelan Sports Ltd.
We reserve the right to alter or amend these terms and conditions at any time without prior notification.
We reserve the right to alter, amend or discontinue products.

All content of this website including but not limited to logos, graphics, photography, video clips, audio clips, text, design and software are the property of Dave Whelan Sports Ltd and are protected by UK copyright laws. Permission is given for you to electronically copy or print hard copies of this website for the sole purpose of placing an order with Dave Whelan Sports Ltd.
  2. Trademarks

    1. You may not use the Dave Whelan Sports Ltd trademarks or the trademarks of any third party without the prior written permission of Dave Whelan Sports Ltd or the third parties, which own the trademarks.
  3. Disclaimer

    1. Dave Whelan Sports Ltd has taken great care in compiling this website. Dave Whelan Sports Ltd, its directors and employees and other company representatives will not be held liable for damages (directly or indirectly) arising from or in connection with the use of this website. Additionally, although every effort has been made to provide accuracy and keep the site free from defects, viruses and other harmful elements Dave Whelan Sports Ltd will not be deemed liable in the event of such occurrences.
  4. Children Under 18 Years of Age

    1. If you are under 18 years of age you must receive the consent of a parent or guardian before you can purchase from this website, send any information to this website, e-mail this website or request any information in digital format or as hard copy.
  5. Deliveries

    1. Delivery services offered are Next Working Day Delivery and Saturday Delivery. Next Working Day Delivery is offered for orders placed which are confirmed as received with an authorised credit or debit card before 12.00 noon from Monday to Thursday (excluding Bank Holiday Mondays) of each week.
      If the order has been placed and authorised before 12.00 noon on a weekday the order will be processed on the same day and sent out for delivery on the following day.
      We do not process orders over the weekend and only process orders on Fridays for customers who have selected Saturday delivery. Any Next Working Day orders received after 12.00 noon on a Thursday will only be processed on Monday (except when the Monday is a Bank Holiday) and will be delivered on Tuesday. This also applies to orders placed on the website on Friday, Saturday and Sunday of a normal working week. We will do our best to process all these orders on a Monday for delivery on Tuesday.
      Upon dispatch of the order the risk of loss, damage or breakage is passed to the customer. Ownership of the goods passes to the customer when payment has been made for the full amount to Dave Whelan Sports Ltd.
      We endeavour to deliver goods on the day specified, but do not guarantee that delivery will take place on that day. We do not accept liability for delayed orders.
      For delivery addresses which rely on ferry services to deliver goods, there is the prospect that services will be delayed or cancelled.
      There are certain locations in the UK where we are unlikely or unable to deliver Next Working Day. Please click here for a list of postcodes for these locations. Customers who order customised goods such as replica shirts which require printing may need to allow for an extra day to process their order as the printing of shirts adds extra time to the order processing.
    2. Free Delivery
      From time to time we may offer free Next Working Day delivery for orders of, or exceeding a certain value. Some of our product range are not included in this offer. These products are mainly Fitness Equipment and Sports Equipment which is costly to despatch due to its bulky or heavy nature and in the majority of cases is despatched directly from our suppliers to your delivery address. For example, if we are offering Free Next Day delivery for orders of £25 and over, if you order an item of Fitness Equipment which costs £100 this will not qualify you for free delivery. However, if you place an order for products from the website which are not excluded from this offer along with Fitness or Sports Equipment which is excluded from the offer, if the total value exceeds £25 the non-restricted stock will be delivered free of charge although the Fitness or Sports Equipment will still need to have despatch paid for if it is applicable. All delivery charges will be clearly stated at the Checkout stage of the buying process.
    3. Delivery Restrictions
      There may be delivery restrictions on some of our products, which we have dispatched directly from suppliers. These products are mainly heavy and bulky goods such as fitness equipment and table games, which our suppliers will not send to certain destinations. Where these restrictions apply it will be stated clearly in the product text. There may be a surcharge for delivery of goods to certain locations due to their remoteness or difficulty in accessing. To find out whether we deliver to your chosen delivery address and how much the product will cost to deliver to this location call our Customer Services Team on 0844 249 5300 and they will be happy to quote you a price for delivery.
    4. Bank Holidays
      We do not process orders when the Bank Holiday falls on a Friday, such as Good Friday, or when Christmas Day or Boxing Day land on a Friday. Orders placed on the Thursday and Friday of such weeks will not be picked until the next working day. If the next working day is Monday then orders placed between 12.01pm on Thursday through until 12.00 noon on Monday would be processed as far as possible on the Monday and delivered on the Tuesday. If a high number of orders were received over the weekend it is possible that some would not be processed until Tuesday. These orders would be delivered on Wednesday. In the event of the Monday being a Bank Holiday orders received after 12.00 noon on the previous Thursday will be processed on the following Tuesday and will be delivered on the Wednesday. The only Saturday deliveries will be for customers who have selected the Saturday Delivery option.
      The latest time that an order can be placed for delivery on Saturday is 11.00am on Friday although we recommend that you place your order no later than Thursday, if possible. Saturday deliveries will arrive with customers by 1.00pm. Delivery is defined as having taken place when the goods are delivered to the selected delivery address. Unfortunately Saturday Delivery is not possible for a number of remote UK locations. Please click here to see those locations.
    5. Deliveries of Fitness Equipment or Table Games sent directly from our suppliers will ordinarily only be placed within the premises of the delivery address at ground floor level. Delivery staff will not carry your purchase up flights of stairs. If you live in a flat and access requires transporting your purchase up flights of stairs or via a lift call our Call Centre staff on 0844 249 5300 to make arrangments to ensure that delivery staff will deliver your purchase to the correct floor.
  6. Returns

    1. If a customer decides to return goods to Dave Whelan Sports Ltd due to them  being damaged, faulty or unsuitable because they are the wrong size, they must be returned within 28 days of the customer originally receiving them. If a customer returns goods because they decide that they no longer want them they must be returned within 7 days of receiving them if they wish to be refunded for the goods. Unwanted goods returned to us later than 7 days after receiving them will be credited by issuing gift vouchers to the purchase value of the goods. Returned goods must be in an unused/unworn condition, with the original packaging and with the delivery docket as proof of purchase. The docket has a section titled “Reason for Return” which must be filled in when returning stock.
      If the goods have been purchased as part of a special offer or package (for example buy 3 items for the price of 2) the entire contents of the offer or package must be returned. When returning goods which consist of a number of separate components all the components which were present when the goods were received must be returned to us.
      Contrary to Returns information printed on the reverse of the delivery docket, customers may NOT return goods bought online to any store for refund or replacement. When the dockets went to print we hoped that it would be possible to return goods to DW Sports stores, but unfortunately we are unable to offer this service at present although we plan to introduce this in the future. If you wish to return goods purchased from the online store for replacement or refund they must be sent via a service which is trackable and traceable. Ensuring that the returned goods reach us without damage is the responsibility of the customer.

      Note that postage for returning goods to us will not be refunded if the goods are unwanted or because the wrong size has been ordered. If we are responsible for an error in sending out goods other than those ordered we will be happy to refund the cost of returning the goods to us provided it does not exceed the delivery fee which we charged to you for original delivery. Goods which are returned to us as damaged or faulty will be examined by our returns department and a decision will be made by them whether a fault or damage to the goods does exist. If they decide that there is a fault or damage you will be offered the opportunity to exchange the goods or receive a refund. Any returned goods deemed to be faulty will be eligible for a refund of your return postage costs provided that they do not exceed the cost incurred in sending the goods to you. If goods are found not to be faulty we will return them to you at your expense. If you have any queries about returns procedure please call our Customer Services Team on 0844 249 5300. Orders for personalised garments, including replica shirts, cannot be cancelled if personalisation has already taken place and will not be accepted as returned goods by Dave Whelan Sports Ltd.
      Please note that all goods returned to us by post must be sent using a method of postage which provides a tracking number so that goods are traceable. Ensuring that the returned goods reach us without damage is the responsibility of the customer.
      Certain items cannot be returned for hygiene reasons once used. They are: swimwear, underwear, swim accessories (such as snorkels), insoles, abdominal protectors, cricket thigh pads, mouthguards, rugby protective clothing, cycling shorts and drink bottles
  7. Orders

    1. Acceptance of your order is confirmed when your method of payment has been cleared by our fraud checkers and not on receipt of credit or debit card details. We reserve the right to refuse any orders for any reason. A confirmation email as a means of order acceptance will be sent to you once your order has been accepted. Our customer services team will deal with any queries or anomalies with your order. Payment is taken from your account when the order is confirmed as picked ready for dispatch except in the case of pre-order offers for new replica kit launches (see below).
  8. Pre Orders

    1. When new replica kits are due for launch, Dave Whelan Sports Ltd may offer customers the opportunity to place an order several weeks before the launch date and receive the kit of choice at their chosen delivery address on the day of the kit launch. In such circumstances the funds for the order would be taken from the customer's account as soon as the method of payment which is offered has passed our fraud checking system. We take the funds at this stage because the authorisation from the banks to take funds only last for a few days. Please note that if you place an order which includes stock on a pre-order offer alongside stock which is not on a pre-order offer you will receive all the items together on the day of the pre-ordered kit launch.
  9. Replica Shirts and Kit

    1. If you place an order which requires personalisation such as shirt printing you may need to allow for an extra day or so beyond the Next Working Day Delivery service as the printing of the shirt adds more time to the order processing.
      If we have non-availability of your required personalisation numbers or letters we may delay or even cancel your order. Once your order has been authorised we cannot refund or replace your purchase.
      Orders for personalised garments, including replica shirts, cannot be cancelled once they have been personalised and will not be accepted as returned goods by Dave Whelan Sports Ltd unless they are faulty.
  10. Product Colours

    1. We endeavour to ensure that the website images closely reflect the true colour and designs of products, but we accept no liability for any variations to the actual product. Specifications may also vary.
  11. Privacy

    1. Dave Whelan Sports Ltd is committed to complying with the Data Protection Act 1998.
      Registration is not required when you order products. However, when you place an order you will be asked to provide certain information about yourself such as your name, address, details of your payment card, telephone number and email address so that we can process and fulfil your order, notify you of your order status and inform you of special offers and promotions.
      Your information can be collected in one of two ways; either directly from you when you register with us or from a third party such as credit reference agencies (for example to assess your credit rating).
      Any additional information we collect will only be with your permission and any communications we undertake will only be with your permission.
      We may use certain information about your use of our website to help analyse and improve the website experience for you.
      Cookies may be used to help improve your speed and access to chosen areas of the website. You can change your browser settings to refuse cookies.
      Dave Whelan Sports Ltd takes its security of data very seriously and will investigate any known security breaches.
  12. Prices

    1. Prices published are for online products only.
      Dave Whelan Sports Ltd reserves the right to change promotional offers and prices without any prior notice and to remove or amend available products at any time. We endeavour to ensure accurate and correct information is displayed for each product. Upon notification of any errors we will investigate and amend information. We are not obliged to supply any incorrectly priced products.
      Prices are displayed in Pounds Sterling. Prices include the prevailing rate of VAT.
      Additional charges are calculated and added for delivery options and will be explicitly displayed on the order total and any order confirmation.
  13. VAT

    1. Prices quoted on the website are inclusive of VAT where it is applicable. If you reside in a location which is VAT free such as the Channel Islands it will be your responsibility to claim back the VAT which you pay. The delivery docket which you receive with your order displays the amount of VAT which you have paid and you can use this docket to reclaim the VAT.
  14. Jurisdiction

    1. The laws of England and Wales exclusively govern all of our terms and conditions and the jurisdiction of these laws shall apply. Access to the website outside of this geographical domain is undertaken at the individuals own risk and Dave Whelan Sports Ltd does not accept liability.
