By using the website you agree in full to the terms and conditions contained herein and furthermore this shall constitute a binding agreement between you and Dave Whelan Sports Limted.

We reserve the right to alter or amend these terms and conditions at any time without prior notification.

Registration

Registration is not required when you order products. However, when you place an order you will be asked to provide certain information about yourself such as your name, address, details of your payment card, telephone number and email address so that we can process and fulfil your order, notify you of your order status and inform you of special offers and promotions.

Children Under 18 Years of Age

If you are under 18 years of age you must receive the consent of a parent or guardian before you can purchase from this website, send any information to this website, e-mail this website or request any information in digital format or as hard copy.

Our Goods

Prices published are for online products only and may differ from store.

DW Sports reserves the right to change promotional offers and prices without any prior notice and to remove or amend available products at any time. We endeavour to ensure accurate and correct information is displayed for each product. Upon notification of any errors we will investigate and amend information. We are not obliged to supply any incorrectly priced products.

Prices are displayed in Pounds Sterling. Prices include the prevailing rate of VAT.

Additional charges are calculated and added for delivery options and will be explicitly displayed on the order total and any order confirmation.

Prices quoted on the website are inclusive of VAT where it is applicable. If you reside in a location which is VAT free it will be your responsibility to claim back the VAT which you pay.

Some products we sell to you come with a manufacture guarantee. For further details please refer to the manufacture guarantee given with the product.

We endeavour to ensure that the website images closely reflect the true colour and designs of products, but we accept no liability for any variations to the actual product. Specifications may also vary.

Purchasing Goods

Acceptance of your order is confirmed when your method of payment has been cleared by our fraud checkers and not on receipt of credit or debit card details. We reserve the right to refuse any orders for any reason. A confirmation email as a means of order acceptance will be sent to you once your order has been accepted. Our customer services team will deal with any queries or anomalies with your order. Payment is taken from your account when the order is confirmed as picked ready for despatch except in the case of personalised items, pre-order offers for new replica kit launches (see below).

Gift & Reward Cards Currently the DW Sports gift cards & reward cards are treated as separate entities and cannot be used when purchasing product online. Sign up to the DW Sports newsletter for great offers online including online exclusives, DW Fitness exclusive member offers, competitions and much more.

Promotional OffersYou cannot use more than one promotion code in conjunction with the same product. Members are able to use their 10% OFF membership number for all other products running out of current promotion.

If you receive an error message after placing an order and clicking "Submit" please check that the billing address matches the address that your payment card is registered to and re-submit. If the two addresses do not match it is likely that your order will be rejected. Please note that if the order is rejected, some issuing banks may still reserve funds to the value of your order for a period of time.

Under The Consumer Protection (Distance Selling) Regulations 2000 you have a right to cancel your order in writing (except for customised products) 14 days beginning with the day after the day on which the consumer receives the goods. Please see returns policy for guidance on method and costs of return.

Pre-Ordering items from DW Sports

When new replica kits are due for launch, Dave Whelan Sports Limited may offer customers the opportunity to place an order several weeks before the launch date and receive the kit of choice at their chosen delivery address and dispatched the day before launch to receipt on launch if next working day is chosen for delivery. In such circumstances the funds for the order would be taken from the customer's account as soon as the method of payment which is offered has passed our fraud checking system. We take the funds at this stage because the authorisation from the banks to take funds only last for a few days. Please note that if you place an order which includes stock on a pre-order offer alongside stock which is not on a pre-order offer you will receive all the items together on the day of the pre-ordered kit launch.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

* Solo cards cease to be valid methods of payment on 31/03/11 and will not be accepted for payment after that date.



Delivery Terms
Delivery

The items offered in our range of products will be delivered via Yodel, UPS, Free to DW Sports Stores & Collect+ depending on the chosen type of delivery and its destination. Assuming that all ordered items are in stock at the time of making the order and that payment has been made immediately after the order is placed, all next day orders made before 12pm Midday on a working day will be dispatched within 2 hours. Orders placed after 12pm Midday on a working day or at any time during a non-working day will be dispatched in the morning of the next working day and the same delivery times apply for Yodel & Collect+ respectively. You can track the status of your order online in "My account". Once your product has been shipped, we will send you a dispatch confirmation via e-mail. This includes a tracking-ID, which you can use to track your order quickly and easily online. We do not accept liability for delayed orders. Please provide us with your complete delivery address and contact telephone numbers as this may help timely delivery.

There are certain locations in the UK where we are unlikely or unable to deliver Next Working Day. Please click here for a list of postcodes for these locations. Customers who order customised goods such as replica shirts which require printing please allow for an extra 2-3 working days to process their order as the printing of shirts adds extra time to the order processing. Next day delivery to Northern Ireland can take up to 3 working days delivery Mon-Fri.

We do not process orders over the weekend. Any Next Working Day orders received after 12.00 noon on a Friday will only be processed on Monday (except when there is a Bank Holiday) where these will be processed on the Tuesday. This also applies to orders placed on the website on Friday, Saturday and Sunday of a normal working week. We will do our best to process all these orders on a Monday. If you wish to cancel your order you have a 2 hour window after placing your order to do so. Please either email online@dwsports.com or call customer services 03301340160 and cancel your order Mon-Fri: 9am-5pm. Any orders placed after 5pm can only be cancelled by email. Please note all weekend orders are eligible for cancellation on the following Monday 9am - 11am

Upon dispatch of the order the risk of loss, damage or breakage is passed to the customer. Ownership of the goods passes to the customer when payment has been made for the full amount to Dave Whelan Sports Limited.

Next Working Day Delivery

Next Working Day Delivery is offered for orders placed which are confirmed as received with an authorised credit or debit card before 12.00 noon from Monday to Thursday (excluding Bank Holidays) of each week.

If the order has been placed and authorised before 12.00 noon on a weekday the order will be processed on the same day and sent out for delivery on the following day Mon-Fri.

Collect+ Service

You will be notified by email once your order arrives to a CollectPlus location. This email contains your collection barcode which you’ll need as evidence along with your ID to allow you to collect your parcel.

Returns Terms

Refunds & Returns

Returned goods must be in an unused/unworn condition, with the original packaging and with the web receipt as proof of purchase. The delivery note has a section titled “Reason for Return” which must be filled in when returning stock.

If you feel that the goods you have purchased online have a manufacturing fault you can return them to us for inspection. If in our opinion there is a manufacturing fault we will replace the goods (subject to availability) or refund them. They must be returned within 7 days of receipt with the original packaging and web receipt as proof of purchase.

Goods must be returned along with a completed Reason for Return section (attached to your web receipt). If you purchase several items as part of a special offer or package and decide that one or more of the items is unsuitable then you must return all items purchased as part of the package or offer.

You may return your order to any DW Sports with a retail store who will be happy to inspect the product on site and issue an exchange instore where required. Should further inspection be required or a full refund be requested this will need to be returned by the store to be dealt with by Head Office. Customer services will contact you accordingly to inform you of the next steps with your order.

All direct return or exchange items must be returned to the DW Sports.com Returns Department at the above address for inspection. If the item is found to be faulty, then you can choose to have it replaced or refunded and the cost which you incurred for posting it back to us will be refunded. If you choose to have a replacement, we will post it out to you for free. If the item is found not to be faulty we will send it back to you, but we will not refund you for the cost of returning it to us.

For hygiene reasons it is not possible for us to accept the return of underwear, mouth guards, drink bottles, footwear insoles or rugby protection items. You are eligible to return these items within 7 days of receipt if damaged/faulty.

Please allow 28 days from the collection or posting date for us to credit your account. We will refund back into your method of payment.

Free Collect+ returns

DW Sports.com has partnered with CollectPlus to enable any UK Mainland customer to easily return their eligible orders. CollectPlus returns take 3-5 working days to be returned back to DW Sports. Most UK Mainland stores are open from early in the morning until late in the night, 7 days a week, making the return of your order as convenient as possible. To find your most convenient store, log onto www.collectplus.co.uk and search by using your postcode.
Returning your order to DW Sports using CollectPlus is only available to UK Mainland customers at this time.

Please remember to keep your receipt as a proof of postage and to track your return.

Free returns to DW Stores

When returning your item(s) please send the web receipt as proof of purchase and fill in the reason for returning.

Please use original packaging if possible and package up securely but remove original labels or cover with returns address. Please do not attach the address directly on to items. Then return to your local DW Store.

Returns via Royal Mail or Courier

Return Terms For Old Electrical Items
WEEE Recycling of Purchased Electrical Items

You can now recycle your old electricals with us.
If you’re buying a new electrical item from our online store, we will recycle your old fitness tracker for free.
Why recycle?
Unwanted electrical equipment is the UKs fastest growing type of waste.

Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.
We can help
We are pleased to offer our customers the chance to recycle their old fitness tracking electrical items.

To help with you complying with the regulations, Dave Whelan Sports Limited will take back an item on a like-for-like basis, when you purchase your new item. We can provide this service provided that the old fitness tracker is returned with 28 days of purchase.
To remind you that your old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment in your bin.

What is WEEE? The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis.

Replica Shirts & Kit Personalisation

If you place an order which requires personalisation such as shirt printing please allow for an extra 2-3 working days to process their order as the printing of shirts adds extra time to the order processing.

If we have non-availability of your required personalisation numbers or letters we may delay or even cancel your order. Once your order has been authorised we cannot refund or replace your purchase.

Orders for personalised garments, including replica shirts, cannot be cancelled once they have been personalised and will not be accepted as returned goods by Dave Whelan Sports Limited unless they are faulty.


Competition Terms

TERMS AND CONDITIONS - BUY ONE AND GET ONE HALF PRICE

  • The discount will automatically be applied in the basket when two or more qualifying items are entered in to the basket.
  • Minimum of two qualifying promotional items need to be entered in to the basket for the discount to be applied.
  • The cheapest of the qualifying items in the basket will have the 50% discount applied.
  • 50 % discount will only apply to products and will not apply to delivery or shirt personalisation.
  • No other promotional discounts will apply to the pair of products in the promotion. Products outside this promotion may qualify for other promotions and discounts when applied at the basket.
